Partner Robert Schartz and attorney Brenna Bushey successfully secured a defense verdict for a pediatric neurosurgeon in a 7-day medical malpractice jury trial.
The patient underwent spinal cord untethering surgery and experienced a post-surgical complication. The complaint alleged that the surgeon was negligent in his care of the child, and sought $7.5 million in damages. The plaintiff did not allow the surgeon to perform the surgery to fix the complication. Schartz and Bushey demonstrated that the surgeon was not negligent, either during surgery or during follow-up care, and that the standard of care by the surgeon was met throughout, which was key to the unanimous decision made by the jury after just over 2 hours of deliberation.
